Terms

Effective Date: December 7, 2025

1. Age Requirement

You must be 21 years of age or older to purchase from OrangeWineAndSpirits.com.

By placing an order, you expressly warrant that:

  1. You are at least 21 years old.
  2. The person receiving the order is also at least 21.
  3. You will present a valid government-issued ID at pickup or delivery.

All shipped orders require “Adult Signature Required.”

If no adult is available, the carrier cannot deliver the order.

2. Pricing & Image Disclaimer

Occasionally, listed prices or bottle sizes may be incorrect (e.g., a 750ml item priced as a 375ml).

We make every effort to keep listings accurate, but errors do occur.

  1. Orange Wine & Spirits will not honor incorrect pricing.
  2. If an error is found, we will contact you before charging your card.
  3. You may choose to proceed or cancel.
  4. We reserve the right to refuse or cancel any order we deem inappropriate or unsafe.

Image Disclaimer:

Product photos are for illustration only. The actual bottle, label, or vintage may vary.

We fill orders based on the product listing text, not the photo.

3. Returns & Refunds

New York State law prohibits returns of alcoholic beverages unless:

  1. The product is defective, or
  2. The product does not match what was listed or ordered

Return Window

Returns or refund requests must be made within 30 days of pickup or delivery.

Damaged or Broken Bottles

If you receive a broken bottle:

  1. Email a photo to us with your refund request.
  2. We will refund the product and related shipping charges.

Flawed Bottles (Corked, Spoiled, etc.)

  1. Only one opened bottle will be refunded for flawed wine.
  2. All opened and unopened bottles must be returned.
  3. Refund will cover the first opened bottle and all unopened bottles.

If the product is sound:

You are responsible for:

  1. All original and return shipping costs.
  2. A 15% restocking fee.

Wrong Vintage or Out-of-Stock Situation

If a vintage listed is unavailable, we will contact you with three options:

  1. Change order to the current vintage.
  2. Remove the item.
  3. Cancel the order entirely.

4. Order Changes or Cancellation

Order Modifications

All changes must be made within 24 hours of placing the order.

Order Cancellation

If you cancel after 7 days, a 15% restocking fee and any payment processing fees apply.

If your order has already shipped, see the Return Policy above.

If an order is returned to us due to failed adult signature:

You will be refunded for the bottles minus shipping charges and a 15% restocking fee.

5. In-Store Pickup & Order Holds

We offer free in-store pickup at our Albany, NY location.

Hold Policy

We can hold products for up to one season or 3 months, whichever comes first.

This protects wine and spirits from extreme temperatures.

6. Shipping Regulations (If and When We Offer Shipping)

Alcohol shipping is restricted by federal and state laws.

By placing a shipping order, you represent and warrant:

  1. You have reviewed your local & state alcohol shipping laws.
  2. You are legally allowed to receive the ordered products.
  3. You are acting in compliance with all applicable regulations.
  4. You or someone 21+ will be available to accept delivery.
  5. You have obtained any required permits or permissions.

Title & Ownership

Title transfers to you once the product is handed to a third-party carrier.

We do not provide shipping services ourselves. Upon your request, we will:

  1. Arrange transportation with a third-party carrier on your behalf.
  2. Charge you all shipping and insurance fees.
  3. Not assume liability for carrier performance.

Alcohol cannot be shipped to PO boxes or restricted states.

7. Weather Conditions

Extreme temperature can damage wine/spirits.

We may delay shipment to protect product quality.

If you choose to ship during severe weather:

  1. You accept full responsibility for potential heat/cold damage,
  2. We recommend expedited shipping (1–2 Day Air),

8. Estimated Shipping Times (If applicable)

  1. Most orders leave within 1–2 business days.
  2. Shipping times exclude weekends.
  3. Shipping estimates are not guaranteed.
  4. Delivery is typically within 7 business days, depending on destination.

For precise tracking, contact the carrier directly after your order ships.

9. Privacy Policy

We value your privacy and will never sell or share your personal information except as required to process your order.

10. Security Policy

Your payment and personal information are protected using SSL encryption, the industry standard for secure online transactions.

11. Payment Methods

We accept major credit/debit cards and other payment methods listed at checkout.

Orders over $5,000 may require a wire transfer at our discretion.

12. Legal Statement

By placing an order with Orange Wine & Spirits, you authorize us to:

  1. Act on your behalf to coordinate transportation with a third-party carrier.
  2. Release your order once handed to that carrier (title passes to you).
  3. Assume you are acting in compliance with your local and state laws.

You further represent that:

  1. You are legally entitled to possess alcohol.
  2. You are purchasing permitted quantities.
  3. You are 21 years of age or older.
  4. You are legally allowed to import alcohol into your state if outside NY.

13. Product Review Guidelines

We allow customer reviews but require:

  1. No obscene, profane, or offensive comments.
  2. No service complaints (reviews must be about the product only).
  3. No defamatory or harmful statements.

Reviews violating these guidelines may be removed.
