Shipping Policy

1. Things to Consider When Shipping Wine & Spirits

Wine and spirits are perishable products. Extreme heat or cold can damage bottles, corks, seals, and overall product integrity.

Our orders ship from Upstate New York, where weather conditions vary greatly throughout the year.

For shipments taking more than 3 days in transit:

We strongly recommend choosing Express Shipping (3 days or less), especially during:

  1. Hot summer months
  2. Freezing winter months

Example:

Ground shipping from NY to the West Coast typically requires 5 business days. During extreme weather, this can expose products to unsafe conditions.

Weekend Holds

To avoid product damage from weekend delays:

  1. We may hold packages until the following Monday
  2. This applies to Ground and Express services (FedEx does not deliver wine on weekends)

2. Adult Signature Required (Federal Law)

All alcohol shipments require:

  1. A valid 21+ adult signature at delivery
  2. Government-issued photo ID
  3. Presence of an adult at the address

The carrier will attempt delivery up to three times.

If the package is returned to us due to failed attempts:

  1. You will be charged return shipping fees
  2. You will be charged for the second shipping attempt

3. Gift Shipments

When sending a gift:

  1. Ensure the recipient is home during delivery hours
  2. Add a gift message at checkout
  3. Remind the recipient they must show ID and be 21+

Adult signature laws apply even for gifts.

4. Business Delivery (Recommended)

Having your order shipped to a business address is preferred because:

  1. Someone is almost always available to sign
  2. Fewer missed deliveries
  3. Often lower carrier rates

5. Where We Ship

We currently ship within the continental United States only.

We cannot ship to:

  1. PO Boxes
  2. APO/FPO addresses
  3. States/counties where alcohol shipping is prohibited

Shipping availability depends on alcohol laws and carrier rules.

6. Order Processing

Orders are processed in the order received.

Processing time is typically:

1–2 business days

Processing time does not include weekends or holidays.

7. Shipping Policy (Legal Title & Responsibility)

All wine and spirits are sold in New York State, and title passes to the buyer in New York at the time of purchase.

By placing an order:

  1. You authorize Orange Wine & Spirits to arrange shipment through a third-party carrier
  2. You represent that you are 21 years of age or older
  3. You confirm that importing alcohol into your state is legal
  4. You accept full responsibility for complying with local, state, and federal alcohol laws

The shipping carton will be clearly labeled as containing alcohol.

We are not responsible for returns caused by:

  1. Failed ID verification
  2. No adult available to sign
  3. Incorrect or incomplete addresses

All return shipping costs are the responsibility of the customer.

8. Shipping Conditions (Weather, Packaging & Liability)

Extreme Weather Holds

We reserve the right to:

  1. Hold your order during extreme heat or cold
  2. Delay release until safe shipping conditions return

This ensures product integrity.

If you choose to ship during unsafe weather:

We cannot be held responsible for:

  1. Heat damage
  2. Freezing damage
  3. Leaking, cork pushout, or compromised seals

We strongly recommend Express or Air shipping during these periods.

Packaging

We use premium wine shipping containers:

  1. Insulated Styrofoam
  2. Molded pulp bottle packaging
  3. Temperature-resistant materials

For orders over 12 bottles:

  1. Shipping will be split into multiple boxes
  2. Example: 14 bottles ship as one 12-bottle box + one 2-bottle box

Carrier Liability

Orange Wine & Spirits is not responsible for:

  1. Damage caused by the carrier
  2. Incorrect handling or storage after delivery
  3. Delays caused by weather or carrier logistics

Shipping Insurance

Insurance is included and covers:

  1. Lost packages
  2. Damaged packages

9. Incorrect Address & Surcharges

Incorrect, incomplete, or changed addresses after shipment may incur:

$10 surcharge (carrier-assessed)

Plus any additional carrier redirect fees.

Return shipping costs will also apply if the package comes back to us.

Shipping charges are non-refundable for returned or refused packages.

10. Estimated Delivery Times

Delivery times do not include weekends.

  1. Ground Shipping: 3–7 business days depending on destination
  2. 2-Day / 3-Day Air: Business days only
  3. Overnight: Next business day (Monday–Friday only)

An Overnight order placed Friday arrives Monday.

FedEx Service Guarantee (Updated 2024)

FedEx no longer offers a money-back guarantee for:

  1. FedEx 2Day®
  2. FedEx Express Saver®

Delays in these services cannot be refunded.

11. Temperature Holds (Seasonal)

We will hold your wine up to one season or 3 months if:

  1. Weather is unsafe
  2. You request a temperature hold

This service is free, with reasonable limitations.

12. Customer Responsibility

By placing a shipping order, you certify that:

  1. You are 21 or older
  2. You have obtained required permits (if any apply in your state)
  3. You comply with all alcohol-importing laws
  4. You accept responsibility for receiving the shipment
  5. You authorize Orange Wine & Spirits to release the package to a carrier on your behalf
